Last year, in a narrow decision, the Supreme Court determined that a suspect must unambiguously invoke a right to remain silent to ensure no statements he makes will be used at trial.
Relying on that ruling, the Second Circuit appellate court determined last month that Plugh’s statements to an FBI agent could now be used at trial.
“Critically, at no point did Plugh unambiguously inform the custodial officers that he wished to invoke his right to remain silent or his right to speak with an attorney,” appellate judge Debra Ann Livingston wrote in the decision.

According to the affidavit Ropp told the girl’s mother “to spank her till she welts up or bleeds.”
When deputies questioned the mother, Dalana Minor said “she knew she had spanked her way too hard but she was a single mother and she has had problems with her daughter being defiant,” according to the affidavit.

A draft of the bill states that failure to report a missing child “whenever the person knows or has good reason to believe that the child is missing” is a misdemeanor that is punishable for up to a year in jail and up to a $1,000 fine.
The crime would rise to a felony if the report is not made within 24 hours and the child suffers serious bodily injury or death. The felony punishment would be up to five years in prison.
