NOT CHILD ABUSE BUT NOTABLE:

FL- PERVERSE ANIMAL CONTROL OFFICER URGES SPAY NEUTER LAW FOR PORT ORANGE, FL! Port Orange Animal Control Officer Barry Jackson, Mandatory Spay Neuter Laws Animal Control Officer Barry Jackson needs a refresher course on the United States Constitution.

Mandatory Spay Neuter Laws violate the 1st Amendment under Freedom Of Religion, Freedom of Speech & Free Association. The Old Testament clearly prohibits castration in Leviticus 22:24. Other religions also prohibit castrating animals. To force a Jew, Jehovah’s Witness, Muslim or any other person to violate their religion by castrating their pet is Unconstitutional.

Mandatory Spay Neuter laws usually provide an exemption only for show cats & dogs that actively participate in animal shows & are registered in professional organizations like CFA, TICA etc. This violates the 1st Amendment under Freedom of Speech & Association because it forces the pet owner to join an organization and participate in activities they might not personally agree with. In a society where the rights to free association is guaranteed by the Constitution – no one should be forced to join an organization just to keep their property from becoming mutilated.

Furthermore, Mandatory Spay Neuter Laws violate the 4th Amendment under Unreasonable Search & Seizure. By law, animals are considered your personal property. Your dog or cats testicles are, to put it bluntly, your property. The state has no legal justification to come in and seize your property (your dogs testicles) for an unreasonable reason. Your dog’s testicles don’t bite, so they’re not a threat to public safety. Your dog’s testicles are not a threat to public health. It’s also not against the law for animals to reproduce!

Spay Neuter Laws violate the 14th Amendment under Due Process. You cannot make a law that takes away a person’s property without giving them their day in court. That’s called Due Process. Spay Neuter laws forcibly take your property without any due process in court.

They’re some that claim that the 10th Amendment gives the State the right to create laws for the good of public safety. For example: vaccines. The state makes laws saying children can’t go to school without having been inoculated. While the State does have a right to make laws for the good of the public under the 10th Amendment – it’s important to remember that the 10th Amendment can not trump the 1st Amendment, under freedom of religion or any of the other Amendments. Even the vaccine laws allow religious exemptions.
