Lyndsey Fiddler appeared in court by video conference on Sunday and said she’d apply for a court appointed lawyer.
The 10-month-old suffered a ruptured spleen and pancreas, severed intestines and blunt force trauma to her head, Treviño said. Doctors told investigators the internal bleeding from her lacerated organs reduced blood flow to her brain, causing irreversible damage that will leave her unresponsive for the rest of her life.
If her mother chooses to pull the plug, investigators will upgrade criminal charges in the case to capital murder.
“I don’t think mom will give consent to unhook the child,” Treviño said.
The sheriff said he would consult with the Hidalgo County District Attorney’s Office on how to proceed with the case and possibly appoint a guardian to decide baby Destiny’s fate.

The family now admits that CNN and Nancy Grace had no wrong doing in the death of Melinda Duckett. So if Nancy Grace has no wrong doing then why is this rotten family taking her money??? Rather than spend their time searching for their 2 year old relative, they’re sticking their hands in a rich woman’s pocket. Police still say, mom, Melinda Duckett, remains the only suspecet in 2 year old Trenton Duckett’s disappearance. And then there are the pictures that show a gruesome tale of torture: A swollen, black-and-blue ankle with a chain still wrapped around it.
