An arrest affidavit by the El Paso County sheriff’s office alleges that Lynch beat Genesis with a belt because the girl soiled herself. The girl was near death for two days, but Lynch and Sims didn’t get her medical help, according to the affidavit. Genesis may have still been alive when she was placed in a plastic bag and buried in the basement, the affidavit said.

The baby’s mom (who didn’t have custody) and grandma both notified officials that they suspected the little girl was being abused in 2009. Case workers made a home visit.

The autopsy performed on Cruz-Carter determined that the cause of her death was asphyxia and multiple traumatic injuries. The autopsy report lists numerous injuries, including, but not limited to, a large bruise measured over 4″ x 3 1/2″ in size, on Cruz-Carter’s lower abdomen, extensive hemorrhaging on the lower right leg that extended depp throughout the leg’s underlying fat tissue, a total of 30 fresh contusions to the child’s head and three injuries compatible to bite marks on her upper back and left thigh.

A Browntown police detective who spoke at the arraignment said Deangelis told them the infant had hit her head on a coffee table as he was moving her to change her diaper. Deangelis also said the baby appeared to be choking on her feeding tube and that’s when he called 911 and the infant’s mother.
