Nixzmary Brown’s 12th Birthday!

Nixzmary Brown was a 7 year old murder victim who was tortured and killed by her stepdad, CESAR RODRIGUEZ, in January of 2006.
Little Nixzmary was kept locked up in her room for hours on end. That room became her prison. She was duct taped to a chair daily. Her foot was tied to a bungee cord that would cut into her flesh when she tried to move. She was being starved and weighed a mere 36 pounds when she died, the weight of a 4 year old! She was so hungry she was made to eat cat food and forced to use a cat’s litter box. All while her brothers and sister were being served hot, home cooked meals. Stepdad, Cesar Rodriguez would beat the 7 year old with a black leather belt and raped her orally while mom, NIXZALIZ SANTIAGO turned a blind eye.
In January of 2006, the family went out on a fun filled shopping trip to the neighborhood Target. Nixzmary, who had bruises and black eyes was left home. The family bought toys and treats for the kids. Power Rangers, Hot Wheels, Play Dough and Bratz dolls were bought for the children. Nothing was bought for little Nixzmary. Stepdad, Cesar Rodriguez, decided to buy some Jello Pudding snacks for his youngest son.
ACS social worker, Joyceline St. Hill had been assigned to Nixzmary Brown’s case, suspecting that she was an abused child. On the evening of January 10th 2006, St. Hill was ordered to visit Nixzmary Brown’s home that evening. She decided that she would put it off until the next morning.
When stepdad, Cesar Rodriguez found out that Little Nixzmary took a Strawberry Jello Pudding snack from the fridge and broke his printer, he punched and kicked her in front of her mother. Then he picked her up as she was kicking and screaming and dumped her into the bathtub like a rag doll. He turned on the faucet and repeatedly dunked the little girl’s head under the freezing cold water as punishment. As she would pull her head out from the water, he’d grab it and push it back under. On one of those grabs, he fatally bashed her soft head into the cold, hard bathtub faucet. Loud bangs were heard coming from the bathroom. Little Nixzmary cried out, “ai, ai, mommy! Mommy!” Mommy came, told stepdad to stop, they hitailed it out of the bathroom, more concerned about her own hide!
When Rodriguez was finished with his water torture, he took Nixzmary back to her room, duct taped her mouth so mom couldn’t hear and used the frail little girl for his own personal punching bag.
Mom, Nixzaliz Santiago came back into the room to check up on little Nixzmary Brown. She gave her a bath, dressed her in a warm sweat suit and lay her down on the floor, next to the radiator to warm up. As Nixzaliz was getting ready to leave the room, little Nixzmary cried out, “Mommy, Mommy, don’t leave me”!
Those were Nixzmary Brown’s last words.
Her mother left her there, lying on the cold, wooden floor and went into the next room to be with her husband.
After Nixzmary’s older brother saw she wasn’t breathing and told mom, Nixzaliz Santiago, Santiago ran to get the upstairs neighbor, Ulbis Rivera to call 911. When Rivera came down into the apartment, she saw a devilish looking, Cesar Rodriguez, pretending to do chest compressions on little Nixzmary!
When cops arrived at the apartment later that morning, what they saw would send shock waves through the City of New York, cause an overhaul to the City’s ACS system and leave everyone with tear stained eyes asking, “why”? There, lying on the cold wooden floor, was the corpse of little Nixzmary Brown! She was naked from the waist up, wearing only a pair of red sweat pants. She had two raccoon like black eyes, a scab over her right eyebrow with the stitches still in there, a scab on her chin that was ironically heart shaped. Her entire face was sunken in from emaciation. There were bruises of every shape and color, yellow, brown, blue, red, going up and down her rail thin body. Bones were jutting out from her shoulders, hips and rib cage, a testament to starvation.
Later that morning when social worker, Joyceline St. Hill finally showed up to visit the family, she was greeted by police cars and the crime scene unit. She was told that little Nixzmary was murdered the evening before – the very evening she was ordered to visit and put off!
Two years later, stepdad, Cesar Rodriguez, was convicted of manslaughter and sentenced to 29 years behind bars. Mom, Nixzaliz Santiago, was also convicted of the same crime – manslaughter. She receieved 43 years in prison, almost a decade longer than her husband.
Barbara Burns, a juror on Cesar Rodriguez’s trial had stated that after the trial, she would wake up from her bed at night in cold sweats and there’d be goosebumps going up and down her body. She stated that there’s a light colored wall in front of her bathroom and that when she comes out of her bathroom at night, that she’d see Nixzmary’s face flash on the wall in front of her! Burns also stated that a lot of nights around 3:00 o’clock in the morning, she and her husband would be awaken by the sound of a little girl crying. Her and her husband would walk through the entire house but there was no little girl!
In 2009 the Governor of the State of New York, David Patterson, signed into effect, NIXZMARY’S LAW which imposes a maximum sentence of life without parole for those that murder a child under age 14 in an especially cruel and wanton manner.
